1. Agreement to Terms

By accessing or using PassagePal, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

PassagePal is an educational technology platform designed to help K-6 students practice reading through decodable passages aligned with phonics skills.

2. Account Types and Eligibility

Teacher Accounts

• Teachers must be at least 18 years old
• Teachers must be affiliated with an educational institution or homeschooling program
• Teachers are responsible for managing student accounts and monitoring student usage
• Teachers must maintain the confidentiality of their account credentials

Student Accounts

• Student accounts must be created and managed by a teacher or parent/guardian
• Students under 13 require parental consent
• Student accounts are subject to teacher and parent oversight

Parent/Guardian Access

• Parents/guardians have the right to access their child's account and data
• Parents/guardians may request deletion of their child's data at any time

3. Acceptable Use Policy

Permitted Uses

You may use PassagePal to:

• Create and assign decodable reading passages
• Track student reading progress
• Generate educational reports and analytics
• Share content within your educational setting

Prohibited Uses

You may NOT:

• Share account credentials with unauthorized users
• Use the App for any unlawful purpose
• Attempt to breach security or access unauthorized data
• Upload malicious code or harmful content
• Use student data for marketing or advertising purposes
• Resell or redistribute App content without authorization

4. Content and Intellectual Property

Your Content

• Teachers retain ownership of custom passages they create
• By using the App, you grant us a license to store and display your content

Our Content

• PassagePal retains all rights to the App, its features, and pre-loaded content
• You may not copy, modify, or create derivative works of our proprietary content

Generated Passages

• Passages generated by the App are provided for educational use
• You may use generated passages in your classroom or educational setting
• Commercial redistribution is prohibited without written permission

5. Privacy and Data Protection

Your use of PassagePal is also governed by our Privacy Policy.

Key commitments:

• We comply with COPPA (Children's Online Privacy Protection Act)
• We comply with FERPA (Family Educational Rights and Privacy Act)
• We do not sell student data
• We do not use student data for advertising

6. Subscription and Payment Terms

Pricing

• Subscription fees are billed in advance on a recurring basis
• Prices are subject to change with 30 days notice

Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods

7. Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or educational opportunities

Educational Disclaimer: PassagePal is a supplemental educational tool. We do not guarantee specific educational outcomes. The App does not replace qualified educational instruction.

8. Children's Privacy and COPPA Compliance

• We comply with COPPA
• We do not knowingly collect personal information from children under 13 without parental consent
• Parents have the right to review, delete, and control their child's information

9. FERPA Compliance

• We comply with FERPA
• We act as a "school official" with legitimate educational interests
• Student educational records are protected

10. Termination

We may terminate or suspend your account if:

• You violate these Terms of Service
• You engage in fraudulent activity
• Required by law or legal process

• Sending email notification to your registered email address

Your continued use of PassagePal after changes become effective constitutes acceptance of the updated Terms.
